Austrian court allows use of Islamic Sharia law in private contracts

 

In a controversial decision, an Austrian court has ruled Islamic law (Sharia) can be used for arbitration purposes in the European country if the contract parties agree on it.

In the case in question two men had signed a contract which mandated that in case of conflicts an arbitration tribunal would decide “based on Islamic law (Ahlus-Sunnah wal-Jamaah) in accordance with equity in the matter to the best knowledge and belief.”

The term Ahlus-Sunnah wal-Jamaah denotes the Sunni Islamic community. 

After a conflict between the two men arose the arbitration tribunal decided against the plaintiff and required him to pay €320,000. The plaintiff then brought suit before the Vienna Regional Court for Civil Matters. He argued that the application of the Islamic law was arbitrary as scholars interpreted Sharia law differently. Furthermore, invoking Sharia law violated the fundamental values of Austrian law.

The (secular) court, however, found that the decision of the arbitration tribunal was lawful. Whether or not Islamic legal rules were applied here could not be verified, according to the Regional Court. The result of the arbitration tribunal did not contradict Austrian fundamental values, and that was all that mattered. Islamic legal provisions, the Regional Court emphasised, could be “effectively agreed upon in an arbitration agreement” for property claims.

The court ruling has caused a storm of criticism about the supposed further “Islamisation” of Austria.

“This opens the door even wider for political Islam”, Michael Schilchegger, an MP and speaker on constitutional law for the right-wing Austrian Freedom Party (FPÖ) wrote in a press statement. “The ruling elevates Islamic parallel societies in Austria and weakens those forces that do not want to submit to Islam. A sad day for the secular constitutional state.”

His party colleague Manfred Haimbuchner echoed the sentiment, writing: “Sharia law is incompatible with the Austrian understanding of law and violates all moral standards that I am familiar with. Unfortunately, our constitutional state is currently powerless against this form of Islam.” 

It is not only right-wingers who are enraged with the court’s ruling. The Turkish Cultural Community (TKG), an association of secular Turks in Austria, protested the decision to recognize the Sharia “as law” and called to attention that the European Court of Human Rights (ECHR) had decided in 2003 that Sharia law and the resulting introduction of a parallel legal system were forbidden in Europe.

“The Vienna court’s decision is a major intervention, today in the secular economy, tomorrow perhaps in production, service, and sales regulations”, wrote Melissa Günes, the TKG’s general secretary.

Knife Crime in Germany Surges 17 % in The First Half of 2025. Foreigners Accounted for 36 % Of Crime Suspects

 


The number of violent knife crimes in Germany has risen sharply once again, with newly released Federal Police figures confirming a worsening trend.

In the first half of 2025, 730 cases were recorded under Federal Police jurisdiction, a 17 percent increase compared to the same period last year. The data, provided by the German government in response to a parliamentary query from Alternative for Germany (AfD) domestic affairs spokesman Martin Hess and obtained by Junge Freiheit, show a marked overrepresentation of foreign suspects.

Out of the recorded offenses, 278 involved German suspects and 270 involved non-Germans. While foreigners make up just under 15 percent of Germany’s population, they accounted for over 36 percent of knife crime suspects. Among them, Syrians formed the largest group with 29 cases, followed by Afghans with 23 and Poles with 20. Algerian and Afghan suspects were among the most likely to use a knife rather than merely carry one, with 83 percent of cases involving actual use.

Huge Inflatable Brings Record 107 Migrants Across Channel to Britain

 

A record 107 small boat migrants have reached Britain in just one dinghy, confounding Labour’s pledge to ‘smash the gangs’.

Images from the port of Dover this morning showed human traffickers have begun to deploy a new, longer type of inflatable.

The dinghy — which can barely be described as a ‘small boat’ — was recovered in the Channel and taken to Dover, where it was being examined by Border Force and law enforcement, GB News reported.

It brought 107 migrants to Britain overnight, smashing the previous record of 96 people aboard one inflatable.

The appearance of the larger type of dinghy further undermines Labour’s decision to concentrate on law enforcement responses to ‘smash the gangs’.

Sírios na Áustria Chumbam de Propósito nos Exames de Alemão Para Continuar a Receber Apoio Social.

 

 

Um novo relatório sobre refugiados sírios na Áustria causou polémica política ao sugerir que alguns migrantes estão a chumbar de propósito nos exames, depois de concluírem os cursos de alemão, para evitar empregos com salários baixos. Os resultados, publicados no diário Kronen Zeitung e baseados num estudo do Serviço Austríaco do Mercado de Trabalho (AMS), provocaram fortes críticas de políticos da oposição, em particular do Partido da Liberdade da Áustria (FPÖ), de direita.

O relatório destaca os desafios na integração dos refugiados no mercado de trabalho, identificando a aprendizagem da língua alemã como um obstáculo fundamental. Uma das sírias inquiridas, uma pediatra que estudou medicina na Síria e trabalhou na Turquia, criticou a tendência de encaminhar as mulheres sírias para “empregos pouco qualificados, como o de limpezas”, sem considerar as suas qualificações reais.

Segundo o relatório, a inquirida referiu que “algumas pessoas chumbavam de propósito nos cursos de alemão para evitar esse tipo de emprego. Um problema central a este respeito são os salários baixos, que não são suficientes para cobrir o custo de vida.” Embora este testemunho levante preocupações, o AMS minimizou a dimensão do problema.

“Pode haver um ou outro caso individual, mas não é uma tendência notória”, disse a agência, mas depois, de forma contraditória, declarou que “as sanções só são possíveis se for claramente provado que alguém sabotou intencionalmente o seu resultado no exame”. A agência observou que é praticamente impossível determinar a intenção.

De acordo com o Fundo de Integração Austríaco, dois em cada três requerentes de asilo e indivíduos com proteção subsidiária precisam de formação em alfabetização, e 44% são completamente analfabetos — um número que complica a eficácia dos cursos de alemão. O relatório provocou reações violentas do FPÖ. O Secretário-Geral do partido, Michael Schnedlitz, considerou o relatório do AMS uma “prova clara de fraude organizada no asilo”.

Numa declaração com uma linguagem forte, afirmou: "O que o FPÖ há muito tempo alertava é agora confirmado pelo próprio sistema: os chamados ‘refugiados’ chumbam de propósito nos exames para explorar os apoios sociais à custa dos austríacos. Este é o cúmulo da audácia e um insulto a todos os cidadãos trabalhadores." Schnedlitz acusou ainda a coligação governamental de negligência

A "battoulah", versão "metálica" da burqa

 


Battoulah (Arabic: بطوله, romanized: baṭṭūleh; Persian: بتوله), also called Gulf Burqah (Arabic: البرقع الخليجي), is a metallic-looking fashion mask traditionally worn by Khaleeji Arab and Bandari Persian Muslim women in the area around the Persian Gulf. The mask is mainly worn in Bahrain, Kuwait, Oman, Qatar, the United Arab Emirates as well as some parts of eastern Saudi Arabia and southern Iran. The mask usually indicates that the wearer is married. Historically, it was also used to fool enemies into thinking that the women they spied from a distance were actually men. 

Multiple variants of the battoulah exist, and some are specific to cities and regions. The "Zabeel cut" design has a narrow top and a broad, curved bottom, and is worn in Dubai and Abu Dhabi. The variant worn in Sharjah resembles the Zabeel cut, but is shaped so the top of the mask is inclined forwards. The Al Ain design features both a narrow top and bottom. 

The Bahraini and Qatari burqa is square. In Oman and Fujairah it is very large and broader at the top with a tip that goes beyond the forehead. In neighbouring Saudi Arabia, the niqab is worn instead. In southern provinces of Iran, Shia women wear red rectangular masks, while those of Sunni women are black or indigo with gold, similar to the mask worn in the Arabian peninsula. In Qeshm, the masks were designed to fool invaders, so they would mistake women for male soldiers.
